General terms and conditions of business

1. APPLICATION

 

1.1. The following general terms and conditions apply exclusively to the business relationship between LUXERY DOGS – Winkler Vanessa and the customer.

 

1.2. The version of these GTC valid at the time of the order applies.

 

1.3 Deviating conditions of the customer are not recognized unless the seller expressly agrees to their validity.​

2. SUBJECT MATTER OF CONTRACT

All details of the respective offer are agreed individually with the customer in advance. Because of this, the contract is concluded.

 

3. CONCLUSION OF CONTRACT

3.1. The contract between the customer and LUXERY DOGS is concluded in electronic business transactions (e-mail via order form, online shop). The offers presented represent a non-binding invitation for the customer to submit an offer.

 

Order process:
Order the desired goods by sending a message using the order form, by e-mail or by ordering in the online shop; Confirmation message about successful sending of the message on the homepage or by email. There is no right of return of the articles made individually for the customer, since they were made to measure.

 

3.2. With the online order, a binding purchase offer is made. The contract is concluded with the acceptance of the purchase offer. The acceptance takes place through the order confirmation by email or in the online shop.

 

3.3. A contract is generally only concluded with customers who have reached the age of 18 and are therefore fully legally competent.

 

3.4. When the customer submits the data, LUXERY DOGS is entitled to store and process the data required for the transaction in compliance with the Federal Data Protection Act and to pass them on to third parties to the extent that this is necessary for the transaction.

4. RESERVATION OF TITLE

The goods remain the property of LUXERY DOGS until full payment has been made.

 

5. PRICES, SHIPPING & RETURN COSTS

5.1.  All prices stated on the seller's website are exclusive of statutory sales tax in accordance with Section 6 Paragraph 1 Z 27 of the Sales Tax Act - UstG.

5.2. In addition to the stated prices, the seller charges shipping costs for the delivery. The amount of shipping costs depends on the country.

5.3. If the goods show signs of damage due to improper handling or soiling, LUXERY DOGS reserves the right to accept a complaint. Custom-made products or unique items are generally excluded from the exchange and right of return.

6. PAYMENT TERMS

6.1. Only the following payment options are available to the customer: payment in advance by bank transfer/invoice in advance or PayPal.

6.2. If the customer does not pay the purchase price in advance by bank transfer or invoice within 10 working days after the conclusion of the contract, he will receive a one-off payment reminder with a deadline via e-mail.

6.3. If the deadline set in the payment reminder expires, the customer's order will be canceled and the seller, LUXERY DOGS, will withdraw from the purchase contract.

7. TERMS OF DELIVERY

The delivery of the goods will be made individually after receipt of payment and sent immediately after completion. On average, this shipment can take place after 2 to 3 weeks. The standard delivery time by the supplier is 5 working days on average. Shipping is from Austria via the post office.

 

 

8. WARRANTY

 

8.1. In the event of a defect, the statutory provisions apply. LUXERY DOGS is not liable for further damage incurred by the customer as a result of the defective delivery. The service recipient can assert the warranty within two years and receive appropriate compensation after examining the defective goods.

 

 

8.2. All products are handcrafted with the utmost care and accuracy.
If a defect occurs in the goods within 2 years, LUXERY DOGS can be informed and further action can be discussed. There is no warranty for damage caused by the customer's own fault or his dog. The customer has to bear the shipping costs for sending and returning the goods.

 

8.3. The product images may differ from the appearance of the delivered goods, especially with regard to color and size.

 

8.4. If delivered items have obvious defects or manufacturing errors, including transport damage, this error must be reported immediately to LUXERY DOGS or the employee of the delivery agent who delivers the item.

 

9. CORRECTION NOTES

If an error has occurred during the order, the customer can send a message via the contact form, email or telephone and have this corrected.

 

10. LIMITATION OF LIABILITY

10.1. Liability for slightly negligent breaches of duty is excluded, provided that these do not relate to essential contractual obligations, damage from injury to life, limb or health, guarantees or claims under the Product Liability Act (ProdHaftG). The same applies to the breach of duty by vicarious agents
The essential contractual obligation is to hand over the item to the customer and to give him ownership of it.

 

10.2. The fasteners that we use to manufacture the products are of industrial quality. These can also open due to unfavorable circumstances or the carabiners can come loose. We assume no liability for these cases. If the dog has not yet mastered basic obedience, we recommend, for example, a safety harness or a collar without a chain.

 

11. IMPORTANT NOTICES ABOUT THE MATERIAL

 

The colors and sizes may vary over time due to environmental influences, light or water due to their nature. Wear and discoloration are possible over time. The care of the materials should only be carried out as described. People and animals can react differently to the tanned leather, the nickel-plated clasps and the dyes used in the materials - please consider this before purchasing the products.

 

The rose gold and black clasps are anodized, making them more delicate than stainless steel and brass. The anodized closures can therefore lose color or flake off under stress. When purchasing this hardware and accepting the terms and conditions, the customer is informed and LUXERY DOGS will not compensate for any damage in this form.

12. EXCHANGE

Our products are made according to individual customer requirements and dimensions and are therefore non-returnable.

 

13. RIGHT OF WITHDRAWAL AND RIGHT OF WITHDRAWAL

We expressly point out that there may not be a two-week right of withdrawal despite a distance contract. This applies in particular to goods that are manufactured according to customer specifications, which are clearly tailored to personal needs, which are not suitable for return due to their nature, which can spoil quickly or whose expiry date has passed (§ 5f KSchG). Since our products are fresh products and are made according to customer specifications, in particular biscuits, cupcakes and cakes, a revocation is therefore excluded.

 

 

14. DATA PROTECTION REGULATION (DSGVO) 

All personal data requested during the online ordering process will be deleted immediately after acceptance of the purchased goods by the buyer or an authorized person.
